O criminalista Ricardo Pieri Nunes, que defende Bruno Henrique, entrou com pedido de arquivamento da investigação contra o atacante do Flamengo, e alegou que forçar cartão não é crime, por lei.
O pedido foi encaminhado nesta terça-feira à 7ª Vara Criminal de Brasília, que decidirá se acolhe o argumento da defesa e arquiva o inquérito, ou se o caso seguirá para o Ministério Público.
Ricardo Pieri afirma na petição que a prática de forçar cartões como parte de estratégia tática é pública e conhecida no meio esportivo, inclusive incentivada por técnicos e admitida por outros atletas.
“Não há dolo de fraudar o resultado, mas sim de se poupar fisicamente ou zerar a contagem de cartões para não desfalcar o time em jogos decisivos”, diz um trecho da petição, publicada inicialmente pelo portal Léo Dias
Bruno Henrique é investigado pelo recebimento do cartão amarelo, de forma proposital, na partida contra o Santos, pela 31ª rodada do Brasileirão de 2023.
O Superior Tribunal de Justiça Desportiva do Futebol (STJD) decidiu reabrir a investigação do caso de Bruno Henrique sobre suposto envolvimento com manipulação de resultados esportivos.
A determinação foi feita por Luís Otávio Veríssimo Teixeira, presidente do STJD, após o recebimento do inquérito produzido pela Polícia Federal que levou o atacante a ser indiciado na esfera criminal.
Veríssimo Teixeira determinou que Maxwell Borges de Moura Vieira, vice-presidente do STJD, será o auditor processante do caso. Ao fim da investigação, o Tribunal vai decidir se denunciará ou não Bruno Henrique.
