Shakira, Messi, CR7, Ancelotti: Espanha ‘fecha cerco’ sobre fortunas e leva astros à Justiça; relembre casos

O técnico Carlo Ancelotti, do Real Madrid, negou a um tribunal espanhol nesta quarta-feira ter cometido fraude fiscal intencionalmente. Ele depôs no dia da abertura de seu julgamento por supostamente não declarar mais de 1 milhão de euros (cerca de R$ 6 milhões) à Receita Federal da Espanha. O caso do italiano, um dos cotados para assumir o comando da seleção brasileira, é o mais recente de uma série de processos desse tipo visando estrelas no país.

A Espanha reprimiu nos últimos anos astros do mundo do futebol e das artes que, segundo as autoridades, não pagaram o que deviam ao Fisco e usaram artifícios para encobrir essa falta. Casos semelhantes anteriores ao de Ancelotti resultaram em sentenças suspensas, geralmente por meio de um acordo extrajudicial.

Ex-Real Madrid e atualmente no Fenerbahçe, da Turquia, o treinador José Mourinho recebeu uma sentença — com suspensão condicional de um ano — após se declarar culpado por fraude fiscal em 2019.

Lionel Messi e Cristiano Ronaldo foram considerados culpados de sonegação fiscal e receberam sentenças de prisão que foram anuladas por serem infratores primários. A superstar colombiana Shakira, por sua vez, concordou em 2023 em receber uma sentença (com suspensão condicional de três anos) e pagar 7,3 milhões de euros (quase R$ 45 milhões) em multas para resolver um caso de fraude fiscal e parar o julgamento.

Os promotores acusaram a cantora de “Hips Don’t Lie” de fraudar o estado espanhol em 14,5 milhões de euros em renda auferida entre 2012 e 2014, acusações que Shakira negou, dizendo que só se mudou para a Espanha em tempo integral em 2015. Ela estava em um relacionamento na época com o zagueiro do Barcelona Gerard Piqué.

Ancelotti assumiu o Real Madrid em 2013, saindo em maio de 2015, antes de ser contratado pelo Bayern de Munique no ano seguinte. Ele comandou o Napoli e o Everton antes de retornar ao Real Madrid em 2021.

Os promotores que acusam o treinador do Real Madrid, Carlo Ancelotti de fraude fiscal, alegam que ele criou um sistema “confuso” e “complexo” de empresas de fachada para esconder seus ganhos extras de direitos de imagem e outras fontes, como imóveis, entre 2014 e 2015. Em depoimento ao Tribunal Superior de Justiça de Madri, o italiano destacou que esse sistema de pagamento lhe foi proposto pelo clube merengue e que “todos os jogadores o fazem”, assim como outro ex-técnico, José Mourinho.

— Quando o clube me sugeriu, coloquei o Real Madrid em contato com meu consultor. Não lidei com isso porque nunca fui pago dessa forma — disse ele. — Nunca percebi que algo não estava certo — acrescentou, dizendo que “nunca considerou cometer fraude”.

Ancelotti disse ao tribunal que nunca percebeu que a empresa que ele havia criado para transferir esses direitos a ele permitiu que ele pagasse menos impostos.

— Naquela época, todos os jogadores e treinadores estavam fazendo dessa forma, parecia a coisa certa a fazer — disse ele.

Os promotores pedem uma pena de prisão de quatro anos e nove meses para o italiano de 65 anos, suspeito de não declarar mais de um milhão de euros (pouco mais de R$ 6 milhões) ganhos de direitos de imagem durante sua primeira passagem pelo Real Madrid.

A acusação argumenta que Ancelotti havia relatado apenas o salário que recebeu do clube e omitido a renda de seus direitos de imagem em suas declarações de imposto de renda durante esse período. Segundo a imprensa espanhola, que credita os cálculos ao Ministério Público, além da dívida tributária cobrada pelas autoridades, o treinador deve pagar uma sobretaxa de 243.593 euros e mais 47.298 euros de juros. Além da multa, o MP exige que Ancelotti pague multas que totalizam 3.186.237 euros. (o equivalente a R$ 19,6 milhões).

Ancelotti chegou ao tribunal com sua esposa Mariann Barrena e seu filho Davide, que atua como assistente técnico no Real Madrid. O julgamento deve durar dois dias. As partes podem chegar a um acordo extrajudicial a qualquer momento do processo.
