José Manuel Rodríguez Uribes, presidente del CSD, sse ha pronunciado en El Cafelito, sobre la petición realizada por LaLiga este lunes para que el juez del ‘caso Olmo’ adopte medidas cautelares y tanto Dani Olmo como Pau Víctor no puedan jugar. “Está en su derecho, es decir, realmente nosotros hemos resuelto un recurso de alzada de Dani Olmo, Pau Víctor y el FC Barcelona, un recurso de alzada que nos elevan, en donde hemos resuelto con criterios estrictamente jurídicos, analizando la petición del FC Barcelona y de los dos jugadores y analizando qué es lo que hizo la Liga y la Federación cuando resolvió en aquel momento el tema de Dani Olmo. ¿Con defecto de forma? Bueno, defecto de forma, yo diría nulidad de pleno derecho“, señaló el dirigente en el podcast de Pedrerol.
Obcecación de Tebas: “No, yo creo que está equivocado, no es que esté obcecado. No tiene ningún sentido, si no haces las cosas bien, insistir, me parece, si no las haces procedimentalmente bien, siguiendo los cauces establecidos, en las formas establecidas, porque en derecho es clave, es fundamental”.
Jugaría Olmo sin el error formal. “Probablemente no estaría jugando”.
El error formal de la Federación y de la Liga ha propiciado que Olmo esté jugando. “Es claro. Si no, no jugaría porque nosotros no tenemos competencia para sustituir a la Liga y a la Federación en el tema de fondo del fair play”.
¿Juega Olmo gracias a Tebas? “Bueno, visto así, esto ya es darle la vuelta, esto es rizar el rizo. Al error de Tebas probablemente sí. De todas formas, no olvidemos que la Liga dijo que el Barcelona sí cumplía el día 3 de enero. Ahora vuelve a cuestionar eso”.
Si gana la Liga acudiendo a la justicia ordinaria, ¿recurriría al CSD? “Pues no creo que tengamos legitimación para eso. Yo creo que nosotros hemos resuelto en alzada y yo creo que si va al contencioso y el contencioso decide, pues lo estudiaremos, lo veremos. Pero en todo caso ya le digo que acataremos también las decisiones. Yo soy muy respetuoso”.
Si el contencioso dice que Olmo y Pau Víctor no pueden jugar, ¿el CSD acatará la decisión. “Sí, porque nuestra obligación es respetar el Estado de Derecho. Es que yo no tengo ninguna duda en eso”.
