Tebas responde a Uribes

Después de que José Manuel Rodríguez Uribes, presidente del CSD, dijera en una entrevista que Dani Olmo está jugando por un error de LaLiga y la Federación, Javier Tebas respondió con un extenso mensaje en X.

Este fue el mensaje completo del presidente de LaLiga.

El presidente del CSD ha señalado públicamente que la responsabilidad en el caso de Dani Olmo es de LaLiga, por haber planteado el asunto en una Comisión de Seguimiento sin competencias. Ante esa afirmación, cabe formular una pregunta sencilla:

¿Quién expidió entonces la nueva licencia de los jugadores Dani Olmo y Pau Víctor?

La propia resolución del CSD no consigue establecer ninguna fecha de expedición, y ante esa ausencia, concluye que las licencias anteriores nunca fueron canceladas.

Este argumento resulta difícil de sostener, por varias razones:

– Las licencias fueron expedidas expresamente hasta el 31 de diciembre de 2024, fecha pactada y firmada por el club y los jugadores.

– Esa fecha no fue simbólica: el propio FC Barcelona acudió a la jurisdicción ordinaria solicitando medidas cautelares urgentes antes de fin de año, alegando que las licencias expiraban el 31 de diciembre.

– Dicha petición fue denegada, pero revela claramente que el club asumía que, a partir del 1 de enero, los jugadores estaban desinscritos.

A partir de ahí, la tesis del CSD de que “no hubo cancelación expresa” y, por tanto, la licencia seguía en vigor, implica reinterpretar unilateralmente un hecho documental claro: la vigencia contractual y reglamentaria firmada hasta el 31 de diciembre.

Y todo ello para concluir que el problema fue… haber llevado el asunto a una comisión inadecuada.

Con todo respeto institucional, creemos que el fondo jurídico no puede reducirse a debates formales sobre foros de debate. Lo relevante aquí es cuándo y cómo se tramitó (o no) una nueva licencia, y si los mecanismos administrativos fueron utilizados de forma coherente con los propios actos de los interesados.

A veces, en el intento de desviar el foco, se olvida que el derecho administrativo también exige consistencia, motivación y seguridad jurídica.
