
Normal erhofft man sich vom Internationalen Sportgerichtshof (Cas) in Lausanne/Schweiz, dass dort strittige und komplizierte Sachverhalte ein für alle Mal geklärt werden. Aber DIESES Urteil wirft Fragen auf.
Im Mittelpunkt: Basketball-Profi Karim Jallow (28) von Ratiopharm Ulm!
Der Ex-Nationalspieler hatte in der BBL-Saison 2021/22 innerhalb von zwölf Monaten drei Doping-Tests verpasst, weil er nicht (wie vorgeschrieben) lückenlos seinen Aufenthaltsort bei der Nationalen Anti Doping Agentur (Nada) gemeldet hatte. Drei sogenannte „Strikes“ in einem Jahr gelten als strafbares Doping-Vergehen. Die Nada wollte Jallow deshalb zwei Jahre sperren.
[–>Doch Jallow (wurde nie positiv getestet) ging gegen die Klage der Nada vor, schaltete das Deutsche Sportschiedsgericht ein und bekam im Dezember 2023 Recht. Das wiederum passte der Nada nicht – und sie zog im Januar 2024 vors Cas.
Jetzt gibt es ein Urteil des höchsten internationalen Sportgerichts. Doch das klingt fast absurd.
Denn: Jallow wird aufgrund eines Verstoßes gegen Meldepflichten rückwirkend für ein Jahr von Januar 2024 bis Januar 2025 gesperrt. Jallow war in dieser Zeit aber durchgehend für die Ulmer im Einsatz – sowohl in der Easycredit BBL als auch im EuroCup. Die Sperre hat also keine Konsequenz!

Die Vorverlegung der Sperre begründet das Cas-Panel mit der langen Verfahrensdauer vor allem im Verfahren vor dem Deutschen Sportschiedsgericht. Die Nada muss akzeptieren, dass das Urteil im Rahmen des gültigen Rechts liegt.
In der Pressemitteilung der Nada heißt es weiter: „Alle Resultate, die der Spieler in diesem Zeitraum persönlich erreicht hat, werden aberkannt, Mannschaftsergebnisse sind davon nicht betroffen.“
Wie SPORT BILD erfuhr, werden die Verfahrenskosten (rund 60.000 Euro) zwischen Jallow und der Nada geteilt. Jallow muss zudem seine Anwaltskosten zahlen – hat aber, nachdem er wegen des laufenden Verfahrens Olympia in Paris verpasst hatte, jetzt zumindest Klarheit.
