CPI que criticou arquivamento de investigação sobre Bruno Henrique não será reaberta; relembre o relatório

A Comissão Parlamentar de Inquérito (CPI) da Manipulação de Jogos e Apostas Esportivas do Senado Federal não será reaberta após o indiciamento de Bruno Henrique pela Polícia Federal.

A CPI criticou a decisão da Procuradoria do Superior Tribunal de Justiça Desportiva (STJD) de arquivar o caso do jogador do Flamengo em seu relatório divulgado este ano.

Houve um adiamento para aguardar os julgamentos de Luiz Henrique, ex-Botafogo, e Lucas Paquetá, do West Ham, mas a CPI acabou encerrada recentemente.

Para que a situação de Bruno Henrique fosse à pauta por parte dos senadores, uma nova CPI teria que ser criada do zero.

Segundo o relatório, o arquivamento foi “claramente precipitado” por não ter aguardado o fim das investigações do Ministério Público do Distrito Federal, segundo o documento.

Ao citar o MP, o texto menciona suspeita de “prévio acertamento” do jogador com familiares e apostadores para a manipulação de apostas, mas não pedia o indiciamento do atleta.

O que dizia o relatório

O relatório da CPI, que teve 692 páginas, cita Bruno Henrique 38 vezes. O documento diz que a Procuradoria do STJD “não levou em consideração” relatórios das empresas de monitoramento International Betting Integrity Association (IBIA) e da Sportradar, os quais apontavam suspeitas de manipulação na partida e teriam sido encaminhados à Justiça Desportiva.

De acordo com informações fornecidas à CPI pela Unidade de Integridade do Futebol Brasileiro da CBF, o primeiro relatório com a suspeita foi enviado à Confederação pela Conmebol em 29 de julho de 2024, quase nove meses após a realização do jogo entre Flamengo e Santos, quando houve a suspeita.

De acordo com informações fornecidas à CPI pela Unidade de Integridade do Futebol Brasileiro da CBF, o primeiro relatório com a suspeita foi enviado à Confederação pela Conmebol em 29 de julho de 2024, quase nove meses após a realização do jogo.

Após o recebimento da nota, ainda de acordo com a CPI, a CBF instaurou uma investigação interna e questionou a Sportradar, empresa contratada pela Fifa e pela Confederação para fazer o monitoramento de competições. A empresa não reportou suspeitas relacionadas à partida em que Bruno Henrique levou cartão amarelo. Em 3 de agosto de 2024, a Sportradar respondeu que “não identificou irregularidades no momento da partida em questão”, mas que reavaliaria a partida “para checar possíveis irregularidades”.

Nove dias depois, a CBF recebeu da Conmebol uma nota contendo “alerta de duas páginas elaborado pela Sportradar que indica possível ocorrência de manipulação na partida suspeita objeto da investigação”.

“De acordo com o alerta, os padrões de apostas e as informações indicam que os apostadores podem ter tido conhecimento prévio sobre o recebimento do cartão amarelo de Bruno Henrique”, diz trecho do relatório. Além da Sportradar, a IBIA, que tem acordo de cooperação com o Ministério da Fazenda, também produziu um documento no qual cita indícios de manipulação na partida em questão.

De acordo com o relatório da CPI, “o STJD optou por arquivar o procedimento tomando por base informação primeira da Sportradar, a qual havia se comprometido a realizar nova análise” e também desconsiderou a existência de relatório da IBIA que apontava “um volume desproporcional (98%) de apostas relacionadas a cartões no jogo Santos X Flamengo (31ª rodada do Campeonato Brasileiro de 2023) direcionadas ao atleta Bruno Henrique realizadas por meio de contas de novos clientes localizados em Belo Horizonte”.

O relatório da CPI afirma que “o arquivamento do processo (pela Procuradoria do STJD) se mostrou claramente precipitado” e que o caso evidencia ineficácia do atual modelo de apuração e punição de eventuais crimes de manipulação de apostas.

“Ainda que se possa argumentar que naquele primeiro momento não havia elementos para uma conclusão de mérito, o STJD poderia ter solicitado informações às autoridades públicas ou, para dizer o mínimo, aguardado o desfecho das investigações”, diz o documento da CPI.

Em novembro, após a realização da operação da PF em que Bruno Henrique foi alvo, o STJD publicou uma nota segundo a qual “os fatos observados (na partida) se coadunam com a realidade razoável da prática do futebol, considerando, notadamente, a ação do atleta no fato assinalado como falta, a intensidade da jogada, a reação do jogador após a marcação da infração e o minuto da partida em que a disputa de bola ocorreu.” Na mesma nota, o tribunal diz ter recebido o alerta da Conmebol, mas que o alerta “não apontou nenhum indício de proveito econômico do atleta” e que, por isso, arquivou o caso.
