Lizenz-Krimi im Handball – Klagt ein Klub den HSV raus?

Wie schon 2024 spielt der HSV Hamburg auch 2025 die Hauptrolle in einem Lizenz-Krimi der Daikin Handball-Bundesliga. Der Klub aus dem Norden bekommt nur dann eine Spielberechtigung für die Saison 2025/26, wenn er bis zum 5. Mai (12 Uhr) die Bedingung erfüllt hat, „dass eine aktuell noch bestehende Liquiditätslücke geschlossen ist“.

Letztes Jahr bekam der HSV die Lizenz erst, nachdem ein unabhängiges Schiedsgericht pro Hamburg entschieden hatte. Investor Philipp J. Müller half mit zwei Darlehen aus. Eines über 4,1, ein weiteres über 2,95 Millionen Euro.

Jetzt gilt er als Haupt-Kandidat für die Zahlung von den angeblich als Lücke ausgemachten 2 Millionen Euro. Vieles klingt wie im Vorjahr, aber es gibt einen entscheidenden Unterschied.

Handball-Bundesliga: Klagt ein Klub den HSV Hamburg raus?

Im Januar 2025 hatte die Handball-Bundesliga (HBL) das Lizenzierungsverfahren und die eigene Lizenzierungsordnung (LZO) „unter Berücksichtigung der geänderten Rechtsprechung des Europäischen Gerichtshofs“ angepasst.

Unter § 13 ist in der LZO nun die „Drittanfechtung von Lizenzierungsentscheidungen“ geregelt. Unter Absatz c steht dort jetzt: „Die Beschwerde (…) kann von einem betroffenen Mitbewerber mit der Behauptung, dass die Lizenzierungskommission bei der begünstigenden Lizenzierungsentscheidung die Vorgaben der zu erfüllenden finanziellen Kriterien hinsichtlich des Lizenzbewerbers beziehungsweise Lizenznehmers nicht rechtmäßig angewendet habe, und dem Ziel, dass das Vertrauensgremium diese Entscheidung überprüfen möge, erhoben werden.“

[–>Weiter heißt es dort nach der Anpassung: „Die Beschwerde ist zu begründen und in der Frist und Form der §§ 13a Abs. 3, 13b Abs. 5 zu stellen. Sie ist nur zulässig, wenn der Mitbewerber (der Beschwerdeführer) schlüssig und substantiiert vorträgt, dass die wirtschaftliche Leistungsfähigkeit oder eine hinreichende Liquidität des Lizenzbewerbers beziehungsweise Lizenznehmers zur Sicherstellung, dass der Lizenzbewerber bzw. Lizenznehmer das laufende sowie das kommende Spieljahr wirtschaftlich durchstehen kann (§ 8 Nr. 2.4 Satzung), tatsächlich nicht gegeben sei.“

Heißt: Andere Klubs der Handball-Bundesliga können nun als „Drittanfechter“ die Entscheidung der Lizenzierungs-Kommission infrage stellen. Vor allem in Betracht käme hierbei jener Klub, der am Saisonende mit Rang 17 den ersten Abstiegsrang belegt.

Aktuell rangiert dort der HC Erlangen. Dessen Aufsichtsrats-Chef ist der Jurist Dr. Carsten Bissel (Bissel + Partner Rechtsanwälte), er ist gleichzeitig Präsident des Stammvereins HC Erlangen e.V..
