Ministério Público de Barcelona recorre de absolvição de Daniel Alves; entenda próximos passos

O Ministério Público de Barcelona recorreu da absolvição do brasileiro Daniel Alves no caso em que o jogador havia sido condenado por estupro de uma jovem em uma boate em dezembro de 2022. A decisão da promotoria foi publicada nesta quarta-feira, após o Tribunal Superior de Justiça da Catalunha (TSJC) anular, no fim de março deste ano, a condenação por insuficiência de provas, o que levou à revogação da pena inicial de quatro anos e meio de prisão imposta ao jogador.

Se o recurso contra a absolvição for aceito, a decisão poderá ser revista pelo Supremo Tribunal da Espanha, instância máxima do Judiciário espanhol.

O TJSC disse que o caso tinha uma série de “lacunas, imprecisões, inconsistências e contradições quanto aos fatos” e que, por isso, “não compartilhava da convicção” da primeira instância. A Corte apontou uma “falta de fiabilidade” do depoimento da jovem que acusou Daniel Alves, especificamente sobre fatos que puderam ser registrados em vídeo na boate, naquela noite de dezembro de 2022 (a parte considerada “objetivamente verificável”, segundo a Justiça espanhola).

“A história não corresponde à realidade”, considerou o tribunal. Na decisão desta sexta-feira, o TJSC afirmou que, “pelas provas apresentadas, não se pode concluir que tenham sido superados os padrões exigidos pela presunção de inocência”.

O tribunal ponderou que não dar como “provada” a acusação não significava, tampouco, afirmar a versão de Daniel Alves como verdadeira. Mas ressaltou que a doutrina constitucional do país exige um “cânone de motivação reforçado” nas condenações.

Quanto tempo Daniel Alves ficou preso?

Daniel Alves passou 14 meses em prisão preventiva e foi condenado em fevereiro do ano passado. Na época, foi autorizado a aguardar em liberdade a análise dos recursos e deixou o Centro Penitenciário Brians 2 em 25 de março de 2024, mediante o pagamento de fiança de 1 milhão de euros.

Ao longo da investigação, Daniel Alves deu diferentes versões para o ocorrido na boate. Inicialmente, alegou que não conhecia a vítima. Mais tarde, reconheceu ter se envolvido com a jovem, de forma consensual, e mentido para evitar impactos em seu casamento com a modelo Joana Sanz.

O jogador e o Ministério Público entraram com recursos após a condenação de fevereiro de 2024. A acusação e os advogados da denunciante pediam o aumento da pena de Daniel Alves, cuja defesa solicitava a absolvição.

“O Tribunal rejeita os recursos da Procuradoria – que solicitava a nulidade parcial da sentença e, subsidiariamente, a elevação da pena para 9 anos – e da acusação particular – que pedia a elevação da pena para 12 anos – e absolve o acusado, deixando sem efeito as medidas cautelares impostas e declarando, de ofício, as custas processuais”, afirmou a Justiça espanhola, em comunicado, nesta sexta-feira.
