

Real Madrid defender Raul Asencio could face criminal proceedings for allegedly sharing a sex tape involving a minor.
On Wednesday, the San Bartolome de Tirajana court in Gran Canaria confirmed an investigation into the allegations had concluded and that four footballers, including Asencio could face criminal proceedings for allegedly recording and distributing videos of sexual content of a minor and one other woman.

The 22-year-old was named in the starting XI for Madrid’s La Liga game against Mallorca and the statement from the court came before kick-off in the game at the Bernabeu.
The case relates to an alleged incident at a beach club in the south of the Spanish island in 2023. The three other players (Ferran Ruiz, Juan Rodriguez, and Andres Garcia) were arrested in September 2023. After Asencio was called to give testimony as a witness, he then became part of the Guardia Civil (Civil Guard, Spanish law enforcement) investigation. At that point, the club said “a Castilla player and three Real Madrid C players” had made statements to the Guardia Civil “relating to a complaint about the alleged broadcasting of a private video via WhatsApp”. “When the club has detailed knowledge of the facts, we will take the appropriate measures,” it added.
The Athletic reported in February that a Spanish court rejected an appeal on behalf of Asencio for the provisional dismissal of the case. Court documents during that appeal confirmed that one of the women was under the age of 16 when the incident took place.
The statement by the court on Wednesday stated the investigation had concluded. In a document in Spanish, which has been translated, it said it “qualifies (the players’) actions as allegedly constitutive of crimes of discovery of secrets without consent and violation of privacy (article 197.1 of the Penal Code), of distribution and sending to third parties of the videos without warning the victims or their consent (article 197.3) and of recruitment or use of minors for pornographic purposes and possession of the videos without their consent (article 197.4) and of possession of the videos without the consent of the victims (article 197.4)”.
The case has now been sent to the Public Prosecutor’s Office, which can file an indictment and request the opening of a trial against the players or request the case to be closed. This decision is then subject to appeal.

Asencio has made 21 La Liga appearances for Madrid this season while Ruiz, Rodriguez and Garcia, former youth team-mates of Asencio all left the club last summer. Ruiz moved to Girona and the club’s sporting director, Quique Carcel, said in November, “I respect the presumption of innocence,” in relation to the investigation. Rodriguez and Garcia joined teams in Spain’s third division (Tarazona and Alcorcon).
Both Real Madrid and Asencio’s representatives declined to comment.
