Ednaldo cita risco em inscrição das Eliminatórias da Copa ao recorrer ao STF contra afastamento

Ednaldo Rodrigues, presidente afastado da Confederação Brasileira de Futebol (CBF), pediu nesta sexta-feira para ser admitido como parte de um processo no Supremo Tribunal Federal (STF) que trata do tema. Ele alegou ao STF que seu afastamento pode prejudicar a inscrição de jogadores da seleção brasileira na próxima fase das Eliminatórias para a Copa do Mundo.

Na quinta-feira, a CBF, de maneira institucional, também já havia recorrido ao STF contra o afastamento. O relator do caso é o ministro Gilmar Mendes, que ainda não analisou esses pedidos. O afastamento foi determinado na quinta-feira pelo Tribunal de Justiça do Rio de Janeiro (TJ-RJ), pela suspeita de fraude em um acordo que possibilitou a permanência do presidente no cargo.

Ednaldo pediu para ser incluído como terceiro interessado em uma ação direta de inconstitucionalidade (ADI) que tramita na Corte. O processo trata de um tema amplo, a legitimidade do Ministério Público em firmar Termos de Ajustamento de Conduta (TAC) com entidades desportivas, mas já foi utilizado para levar Ednaldo de volta ao cargo em janeiro de 2024, após ele ter sido afastado pela primeira vez.

Agora, o presidente afastado alega que os mesmos fundamentos devem ser aplicados. No ano passado, Gilmar Mendes determinou que ele retornasse ao posto alegando que o prazo inscrição do Brasil no torneiro qualificatório para as Olimpíadas de Paris estava próximo e que o processo poderia ser prejudicado caso a destituição fosse considerada irregular.

Dessa vez, Ednaldo alega que a CBF está a “poucos dias do encerramento do prazo legal” de inscrição dos jogadores que vão disputar o próximo jogo das Eliminatórias da Copa, que irá ocorrer em 5 de junho.

“Qualquer dúvida quanto à legitimidade do signatário da lista de convocação, ou sua eventual substituição por interventor não reconhecido pelo sistema FIFA, enseja a rejeição do ato administrativo de convocação da Seleção Brasileira e pode impedir a participação da equipe nos próximos compromissos internacionais, com impacto esportivo, financeiro e diplomático de proporções imensuráveis”, alega a defesa do presidente afastado.
