Das Thema Altersdiskriminierung beschäftigt den DFB – nicht nur wegen des Rechtsstreits mit Ex-Schiedsrichter Manuel Gräfe (51), der seine Bundesliga-Karriere 2021 wegen der Altersgrenze von 47 Jahren beenden musste und auf Schadensersatz in Höhe von 830 000 Euro klagt. Das Landgericht (LG) Frankfurt hat die damals beim DFB gängige Regelung bereits für nicht rechtmäßig erklärt und Gräfe 48 500 Euro Entschädigung zugesprochen. Die reichen dem Berliner nicht, er ging in Berufung vor dem OLG.
Mit Blick auf den DFB-Bundestag im November und der als sicher geltenden Wiederwahl von Präsident Bernd Neuendorf (63) überprüft der DFB nun seine Satzung auf mögliche Verstöße gegen das Allgemeine Gleichbehandlungsgesetz (AGG), um neue Diskriminierungs-Klagen auszuschließen. Dafür wurde extra eine Satzungskommission aus Rechtsexperten von DFB und DFL gebildet. Die Bundesliga ist mit im Boot, weil ihre DFL-Präsidiumsmitglieder automatisch auch Posten im DFB-Präsidium und -Vorstand übernehmen.

Geprüft wird, ob eine Geschlechtsdiskriminierung vorliegen könnte, weil für bestimmte Positionen entweder nur Frauen oder nur Männer vorgesehen sind. Und ob die Altersgrenze von 70 Jahren eine Altersdiskriminierung darstellen könnte.
In der DFB-Satzung unter Paragraf 19, Punkt 8 heißt es: „Die Wahl, Neuwahl, Bestätigung oder Berufung für ein Amt im Präsidium, im Vorstand, in den Rechtsorganen, im Prüfungsausschuss oder in den Ausschüssen ist nur bis zur Vollendung des siebzigsten Lebensjahres möglich.“ Aus diesem Grund scheidet Manfred Schnieders (70), der als Präsident des Westfalen-Verbandes (FLVW) im DFB-Vorstand sitzt, im November aus.
Die Satzungskommission prüft rechtlich und inhaltlich, ob die Altersgrenze erforderlich ist oder einen Verstoß gegen das AGG darstellt.
Die wahrscheinliche, weil rechtssichere Lösung: eine Amtszeitbeschränkung von zwei (insgesamt acht Jahre) oder drei Wahlperioden (zwölf Jahre). Damit würde auch eine Forderung der Uefa erfüllt werden: Im „Governance Framework“ für die 55 Mitgliedsverbände wird unter Punkt 1.6. eine Amtszeitbeschränkung in der Verbandsführung von maximal zwölf Jahren verlangt.
[–>Amtszeitbeschränkungen gibt es u. a. schon bei der Fifa, Uefa und beim Internationalen Olympischen Komitee (IOC). Nötig wäre ein Antrag auf Satzungsänderung, über den die zuletzt 262 Delegierten auf dem Bundestag abstimmen.
