Diese Nachricht trifft die DFL und ihre 36 Profiklubs unerwartet hart: Das Bundeskartellamt teilte am Montag in einer vorfinalen Bewertung zwar mit, dass die umstrittene 50+1-Regel mit nationalem und europäischem Kartellamt vereinbar sein kann – allerdings nur unter drei Bedingungen, die von der Bundesliga erfüllt werden müssen.

Die gravierendste: Es darf keine 50+1-Ausnahmen mehr geben. Und ein Bestandsschutz darf nur temporär gelten, nicht dauerhaft. Dies betrifft die beiden Werksklubs Bayer Leverkusen und VfL Wolfsburg. Hier hat der Mutterverein (e.V.) keinen beherrschenden Einfluss auf die ausgegliederte Profifußball-Abteilung, was 50+1 aber zwingend vorschreibt, damit Investoren sich nicht ins Tagesgeschäft einmischen können.

Weitere Bedingungen: Die DFL muss mit Blick auf 50+1 die Offenheit der Vereine sicherstellen, was den Zugang zur stimmberechtigten Mitgliedschaft und damit für die Mitbestimmung der Fans betrifft. Hier ist RB Leipzig mit seiner Vereinsstruktur und dem Investor Red Bull betroffen.

Die dritte Bedingung betrifft die Organisations-Regeln auf Mitgliederversammlungen der 36 Klubs: Die DFL muss prüfen und sicherstellen, dass Weisungen des e.V. an die Vertreter der Profi-Abteilung, bei Abstimmungen befolgt werden. Auslöser ist die Abstimmung über den geplanten Einstieg eines DFL-Investors im Frühjahr 2024: Hannover 96 e.V. hatte Geschäftsführer Martin Kind angewiesen, gegen den Investor CVC zu stimmen. Angeblich soll sich Kind nicht an die Weisung gehalten haben, wofür es aber keinen Beweis gibt, da die Abstimmung geheim war.

[–>Die DFL-Geschäftsführung und das Präsidium stehen nun vor der schwierigen Aufgabe, die Bedingungen zu erfüllen, damit 50+1 nicht gekippt wird. Einen Zeitrahmen gibt die Bonner Behörde der DFL nicht vor, ein „längerer Übergangszeitraum“ sei gerechtfertigt. Die rechtliche Auseinandersetzung zwischen DFL und Kartellamt läuft seit 2018.
