By rejecting the arbitration route, the court has cleared a path for Gruden’s case to be heard publicly. The 5-2 decision from Nevada’s high court underscores that forcing a former employee into arbitration overseen by a defendant in dispute, Goodell in this case, violates basic fairness.
Gruden’s legal team hailed the outcome, calling it “a victory not just for Coach Gruden but for all employees facing an employer’s unfair arbitration process”. The NFL has pushed back, announcing plans to seek a rehearing before the Nevada Supreme Court with a potential appeal to the U.S. Supreme Court if needed.
