Da droht eine Schlammschlacht vor Gericht – Ausgang völlig offen!

Sportlich läuft es für die HSV-Handballer (31:29 Punkte), wirtschaftlich ist es so lala, die Lizenz sicherte sich der Handball-Bundesligist erst nach Zahlung einer Millionensumme. Jetzt droht dem HSV Ungemach vor Gericht.

Öffentliche Sitzung der 15. Kammer des Arbeitsgerichts Hamburg, Saal 315, mit der Vorsitzenden Richterin Sabrina Bellasio. Der Termin wurde nötig, weil eine außergerichtliche Einigung zwischen dem HSV Hamburg und dessen Ex-Geschäftsführer Sebastian Frecke bislang scheiterte. Auch während der Sitzung, die knapp 45 Minuten dauerte, kam es zu keiner Übereinkunft.

Darum geht es im Kammertermin (Az 15 Ca 434/24): Ex-Geschäftsführer Frecke hatte Kündigungsschutzklage gegen den HSV e. V. eingereicht. Nach seiner Abberufung als Geschäftsführer im vergangenen September wurde, so argumentiert Frecke – vertreten durch Jan Ruge und Felix Uhr (Fachanwälte für Arbeitsrecht) – sein alter Arbeitsvertrag beim e. V. wieder aktiv. Parallel läuft eine Urkundenklage vor dem Landgericht.

Grundsätzlich gilt eine Zwei-Wochen-Frist, in der dem Geschäftsführer hätte gekündigt werden müssen, nachdem das HSV-Präsidium Kenntnisse von Vorfällen erlangt hat, die eine Weiterbeschäftigung unmöglich machten. Der HSV führt hier u. a. Ungereimtheiten in der Abführung von Steuern und Sozialversicherungsbeiträgen an, die ein Bericht vom Juni 2024 zutage gefördert hätte.

Der HSV, vertreten durch Christina Wilkens und Jonas Warnken (Kanzlei Taylor Wessing), geht von der Rechtmäßigkeit der fristlosen Kündigung aus und ist überzeugt, alle Fristen gewahrt zu haben.

[–>Der Kammertermin brachte überraschende Details ans Licht. Kurios u. a.: In der Verhandlung kam heraus, dass der HSV seinen Ex-Geschäftsführer gekündigt hatte. Angeblich betriebsbedingt, nach einer unternehmerischen Entscheidung – so jedenfalls wurde es auch vor Gericht erwähnt.

Im Vorjahr hatte der Verein – Präsident Kay Spanger und seine Mitstreiter – allerdings wiederholt auf Medien-Anfragen eine Kündigung abgestritten, stattdessen auf die großen Verdienste von Frecke hingewiesen. Und darauf, dass Frecke selbst um Auflösung gebeten hätte.

Aufsichtsratschef Wilken Möller in der Pressemitteilung des Klubs: „Wir danken Sebastian, dass er konstruktiv und im Sinne des Vereins auf uns zugekommen ist, damit wir mit neuer Energie die nächsten Aufgaben angehen können. Wir danken ihm auch ganz herzlich für die geleistete Arbeit und die damit verbundenen Erfolge in den verschiedenen Verantwortungsbereichen. Er hatte großen Anteil daran, den Verein unter teilweise schwierigen Rahmenbedingungen zu dem zu entwickeln, was er heute ist.“

Bei Gericht – Streitwert knapp 100.000 Euro – klang das ganz anders. Die aktuellen HSV-Bosse, die Frecke vor rund einem Jahr ins Boot holte, hätten viele Dinge gar nicht oder viel zu spät erst erfahren. So heißt es plötzlich.

„Ich habe den Eindruck, sie streiten sich um des Kaisers Bart“, erklärte die Vorsitzende Richterin. Konter des Klägers: „Nein, wir streiten um den Fortbestand des Arbeitsverhältnisses.“

Bellasio: „Eine Einigung gibt es offensichtlich nicht.“ Stimmt leider!

Ein versuchter Vergleich scheiterte. Der HSV sieht sich im Recht, wollte plötzlich aber zwei Geschäftsführer-Gehälter (à 10.500 Euro) zahlen – insgesamt 22.000 Euro. Freckes Anwälte lehnten ab, sehen ihren Mandanten ebenfalls im Recht und fordern das Gehalt bis einschließlich Mai (sieben Monate), sie sehen u. a. die Fristen nicht eingehalten.

Wie geht es weiter? Weil das Gericht jetzt noch Zeugen hören will, wurde die Verhandlung vertagt. Ein nächster Termin – frühestens wohl in zwei Monaten. Der Verlierer wird dann wohl in Berufung beim Landesarbeitsgericht gehen. Sofern man sich nicht außergerichtlich einigt.

Eine Schlammschlacht droht – ein weiterer Imageschaden für den HSV wohl auch.
